Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and Book My Points ("we", "us", "Book My Points") governing your use of our websites, apps, and services (collectively, the "Services"). Please also read our Privacy Policy, which is incorporated by reference. By creating an account, submitting a booking request, listing as an owner, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. What Book My Points is (and isn't)

Book My Points is a peer-to-peer marketplace and matching platform that connects timeshare points owners with travelers ("guests") who want to stay at properties bookable through those points programs. We are not the resort, the points program, a travel agency, a tour operator, or a financial institution.

All reservations are made by an owner using their own points balance with the underlying program (for example, Marriott Vacation Club). Book My Points coordinates the match, verifies the reservation directly with the resort, and handles payments and payouts. We are not a party to the underlying reservation itself.

3. Eligibility and accounts

  • You must be at least 18 years old and able to enter into a binding contract.
  • Accounts are personal. Sign-in is via email magic link; protect access to your inbox accordingly.
  • You agree to provide accurate, current information and to keep it up to date.
  • The Services are intended for individual travelers and individual points owners — not travel agents, brokers, or resellers.

4. Guest terms

  • Submitting a booking request authorizes Book My Points to place a temporary card hold for the maximum quoted amount plus the applicable booking fee. Holds are released automatically if no owner can fulfill the request within the platform's timeout window.
  • When you confirm a proposal, you authorize capture of the confirmed amount upon successful resort verification.
  • The reservation is in the guest's legal name and is governed by the resort's check-in, ID, and house rules. You are responsible for taxes, resort fees, incidentals, travel, parking, and insurance unless explicitly included in the quote.
  • Guests may have up to three active booking requests at a time, subject to platform-level limits and karma-style controls.

5. Owner terms

  • You represent that you own — or are authorized to use — the points you make available, and that doing so does not violate your contract with the underlying program.
  • When you acknowledge a lottery opportunity, you commit to proposing a reservation within the platform's timeout window. Repeated acknowledge-without-propose behavior reduces karma and may result in suspension.
  • Once a guest confirms, you agree to book the actual reservation with the program in the guest's name, share the confirmation number with us, and not cancel the reservation except in narrowly-defined extenuating circumstances coordinated with Book My Points.
  • Payouts are issued via Stripe Connect Express after the resort verifies your reservation and the 14-day post-stay dispute window closes without issue. You are responsible for any taxes on income earned through the platform.
  • Cancelling a confirmed reservation outside agreed-upon circumstances may result in chargebacks, removal from the platform, and karma forfeiture.

6. Fees, holds, and payouts

Book My Points charges a booking fee that is disclosed on every quote before you confirm. The fee covers matching, verification, payments infrastructure, and platform support. Pricing, points-to-dollars rates, and payout schedules are described in-product and may change from time to time.

Card holds are placed via Stripe and may be reauthorized if the hold is at risk of expiring before capture. Captures occur upon successful resort verification. Payouts to owners are released after the dispute window closes.

7. Cancellations and refunds

  • Until you confirm a proposal, you may cancel your request at any time. Holds are released and you are not charged.
  • After confirmation, the refund policy you selected at booking (non-refundable, partly refundable, or fully refundable) applies.
  • Bookings within 65 days of check-in are non-refundable, matching the underlying program's policy.
  • If an owner fails to fulfill or cancels a confirmed reservation, you receive a full refund and we attempt to re-match you when possible.

8. Disputes

A 14-day dispute window opens after check-out. If something meaningfully went wrong with your stay (e.g., the reservation was cancelled by the owner without notice, or the room materially differed from what was confirmed), you may file a dispute through your booking page. Book My Points admins review disputes and may issue full or partial refunds, hold owner payouts, or require additional documentation. Outside this window, dispute eligibility is limited.

9. Acceptable use

You agree not to:

  • Misrepresent yourself, your ownership, or the nature of a booking.
  • Use the Services to launder money, evade taxes, or facilitate fraud.
  • Circumvent the platform to take a confirmed match off-platform (this harms the karma system, depletes the safety net for other users, and is grounds for removal).
  • Scrape, reverse-engineer, or interfere with the Services' infrastructure, security, or rate limits.
  • Harass, threaten, or discriminate against other users or Book My Points staff.

10. Intellectual property

Book My Points and our licensors own the Services, including all software, content, designs, and trademarks. We grant you a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. You retain ownership of content you submit (e.g., chat messages, reviews) and grant us a non-exclusive license to host, display, and use it to operate and improve the Services.

11. Third-party programs and services

The Services rely on third parties — including Stripe (payments and payouts), Cloudflare (hosting and email), and the underlying resort program (e.g., Marriott Vacation Club). Their terms govern their respective services. Book My Points is not affiliated with, endorsed by, or sponsored by Marriott Vacation Club or any other resort program; brand names appear for identification only.

12. Suspension and termination

We may suspend or terminate your account if you violate these Terms, abuse the platform, create undue risk, or fail to maintain Stripe verification. You may close your account at any time by emailing contact-us@bookmypoints.com. Sections that by their nature should survive termination (payments, disputes, IP, disclaimers, liability, indemnity, governing law) will do so.

13. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that requests will be matched, that an owner will fulfill any particular booking, that the Services will be uninterrupted or error-free, or that any content is accurate or complete. Travel carries inherent risk; you are responsible for your own travel insurance and contingency planning.

14. Limitation of liability

To the fullest extent permitted by law, Book My Points and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to the Services. Our aggregate liability for any claim relating to the Services will not exceed the greater of (a) the total fees you paid to Book My Points in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100). Some jurisdictions do not allow these limitations; where that is the case, our liability is limited to the smallest extent permitted.

15. Indemnification

You agree to defend, indemnify, and hold harmless Book My Points from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Services, your content, your violation of these Terms, your violation of the underlying program's rules, or your infringement of any third-party right.

16. Governing law and arbitration

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration under the rules of the American Arbitration Association, except that either party may bring claims in small-claims court if eligible. You and Book My Points each waive the right to a jury trial and to participate in a class action.

If any provision of these Terms is held unenforceable, the remainder will remain in effect.

17. Changes

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you by email or in-product banner. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
